This website is owned and operated by Pomards SAS (SIRET 951 378 033 00017), 61 Rue de Lyon, 75012 Paris, France. These Terms set forth the terms and conditions under which you may use our website and services and which apply to all legal relationships between you and Pomards SAS via ‘Where should I go?’.

By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

You must be over the age of 18 to use our website and our service and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

Service

We provide personalized and/or pre-made travel guides to our customers. We do not take any responsibility that you will be able to carry out or use the recommendations you receive through one of our guides. The opening hours indicated in our guides are not binding and are the responsibility of the respective provider.

If you use the service of a third party recommended by us, you enter into a contract with the respective provider or service provider, to which the offer and terms of the respective provider apply. We disclaim any responsibility for anything that occurs before, during or after your trip, including while you are engaged in one of our recommendations.

We have tested each of our recommendations within our standard categories as found in the form you fill out. If you ask for something outside of our standard catalog, we will do our best to find what you are looking for, but the result may be something we have not tried ourselves, or we may not be able to find anything at all that meets your criteria.

Purchases and fee changes

When buying a product, you agree that: (i) you are responsible for reading the full listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase a product when you commit to buy an item and you complete the check-out payment process.

The prices we charge for using our services and products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur.

Refunds

We do not provide refunds for our products. However, you can request that up to 25% of your personal recommendations will be changed once at no additional cost. This must be requested by email. Any subsequent change to your personal guide will be charged at the appropriate portion of the original price. No refunds or changes can be requested for our packages.

Copyright

The copyrights and all other rights to the content, images, photos or other files on the website belong to Pomards SAS, as well as other rights holders who grant us the appropriate rights. The written consent of the copyright holders must be obtained in advance for the reproduction of any element.

Disclaimer

We are not liable for any damages caused from using our products or services. Further, we are not liable for the topicality, correctness, completeness or quality of the information provided. Liability claims regarding damage caused by the use of any information provided, including any kind of information which is incomplete or incorrect, will therefore be rejected.

All offers are subject to change and non-binding. We reserve the right to change, supplement or delete parts of the website and/or our service without prior notice or to discontinue the publication temporarily or permanently.

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

You agree to indemnify and hold Pomards SAS harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

In no event shall we be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

Liability for links

References and links to third party websites are beyond our responsibility. Any responsibility for such websites is declined. The access and use of such websites is at the user’s own risk.

Force majeur

If we cannot fulfill our contractual obligations due to force majeure, we are not liable for any damages or poor performance. If we are unable to provide you with the personalized guide you purchased at all, you will be entitled to a refund of the amount already paid. Force majeure also includes the absence of employees of Pomards SAS, in particular as a result of illness, accident or termination without notice.

Modification of Terms

We reserve the right to modify these terms at any time at our sole discretion. Therefore, you should review this page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of our website and/or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

By accepting our Terms and Conditions, you automatically subscribe to our newsletter. By this, you agree to receive from time to time promotional messages and materials from us. If you don’t want to receive such promotional materials or notices – please just notify us at any time or click unsubscribe in the newsletter.

Place of jurisdiction

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of Paris, France, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Paris. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
